Terms of Service

1. Agreement

By creating an account or using Lama ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. Lama is operated as a sole proprietorship ("we", "us", "our").

2. What Lama is

Lama is an AI-powered web testing tool. It consists of:

• A desktop application for writing, running, and managing tests.
• A Chrome browser extension that connects the desktop app to your browser for automated testing.
• A website at lamaqa.com for account management and billing.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for keeping your login credentials secure.
• You must be at least 18 years old to use the Service.
• One person per account. Sharing login credentials is not permitted.
• You are responsible for all activity under your account.

4. Credits and billing

Lama uses a credit-based billing system:

• You purchase credits in advance. Credits are deducted based on AI model usage (token costs plus a service markup).
• Credit balances are non-refundable except where required by applicable law.
• Pricing is displayed before purchase and may change. Existing credit balances are not affected by price changes.
• We may offer free trial credits at our discretion. Trial credits expire and cannot be converted to cash.
• Payment processing is handled by Polar Software GmbH ("Polar"). By purchasing credits, you also agree to Polar's terms.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to circumvent usage limits, billing, or access controls.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Share, resell, or sublicense your account access to others.
• Use the Service to generate harmful, abusive, or illegal content through AI models.
• Interfere with or disrupt the Service or its infrastructure.

6. AI-generated content

Lama uses third-party AI models to generate test code, suggestions, and analysis.

• AI output may be inaccurate, incomplete, or unsuitable for your use case. You are responsible for reviewing and validating all AI-generated content before using it.
• Your use of AI features is also subject to the terms of the underlying AI providers.
• You retain ownership of the test code and content you create using the Service.

7. Your content

You retain all rights to the code, tests, and data you create with Lama. We do not claim ownership of your content. By using the Service, you grant us a limited license to process your content solely to provide the Service (e.g., sending page content to AI models for analysis).

8. Intellectual property

The Service, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service except as expressly permitted.

9. Availability and support

• We aim to keep the Service available but do not guarantee uptime. Downtime may occur for maintenance, updates, or reasons beyond our control.
• Support is provided via email on a best-effort basis. We do not offer guaranteed response times.
• We may modify, suspend, or discontinue features of the Service at any time.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

• You may delete your account at any time by contacting us at hi@lamaqa.com.
• We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay for usage.
• Upon termination, your right to use the Service ends. Data may be deleted in accordance with our Privacy Policy.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through a notice in the application. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
